Terms of Service

1. Who we are

These Terms of Service ("Terms") govern your access to and use of the DataGreat tourism intelligence platform, websites at datagreat.com and all subdomains, mobile or desktop applications, APIs, and related services (collectively, the "Service") operated by:

By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You may use the Service only if you:

are at least 18 years old;
have the legal capacity to enter into a binding contract under Turkish law (or, where applicable, the law of your jurisdiction);
are not barred from receiving the Service under applicable law (including export-control or sanctions law);
are using the Service on behalf of an organisation only if you have authority to bind that organisation, in which case "you" includes the organisation.

Accounts may be created by individuals or by organisations through a designated administrator. Each account is for a single user/seat unless the applicable plan tier permits more (see §6).

3. Account & registration

You must provide accurate registration information and keep it current. You are responsible for safeguarding your credentials and for all activity that occurs under your account. You must notify us promptly of any unauthorised use.

We may refuse, suspend, or terminate accounts at our discretion where required by law, where Terms are violated, or where activity threatens the integrity of the Service.

4. The Service

DataGreat is a B2B tourism intelligence platform that delivers verified market data, AI-generated personas, campaign briefs, risk radars, crisis simulations, and related analytical artefacts derived primarily from licensed third-party datasets (including but not limited to the World Travel & Tourism Council Economic Impact Research, the World Bank, and the International Monetary Fund).

The Service is provided AS IS and AS AVAILABLE. We make no warranty that the Service will be uninterrupted, error-free, or suitable for a particular purpose, except as expressly required by applicable consumer-protection law.

5. AI outputs — important disclaimer

The Service uses large language models (currently Anthropic Claude Sonnet 4.6) to humanise structured data into narrative outputs (personas, briefs, simulations, risk narratives). All numeric values are computed from verified data via deterministic rules; the AI is not permitted to introduce numbers absent from the source data, and a server-side validator nullifies any that escape that constraint.

Notwithstanding these safeguards, AI outputs are estimates and may contain errors, omissions, or out-of-context interpretations. You agree:

to verify any AI-produced output against the cited sources before acting on it;
not to rely on AI-produced output as the sole basis for any business, financial, legal, medical, or safety-critical decision;
that DataGreat is not liable for losses, damages, or consequences arising from your reliance on AI-produced output, to the maximum extent permitted by law.

Each AI output is labelled with a confidence rating and source citations. Use them.

6. Plans, billing, and renewals

We offer multiple subscription tiers (Explore, Researcher, Analyst, Agency, Institute) with associated monthly or annual fees and resource quotas. The current matrix is published at datagreat.com/pricing and incorporated by reference. Quotas are calculated on a rolling 30-day window from your subscription start date.

Paid plans renew automatically on the anniversary of your subscription start, at the then-current rates, until cancelled. You may cancel at any time through the billing portal; cancellation takes effect at the end of the current period — we do not pro-rate part-period fees, except where required by Turkish consumer-protection law for digital content not yet delivered.

Payments are processed by Stripe. By providing payment information, you authorise us and Stripe to charge your payment method for the applicable fees, taxes, and any overage charges defined in the plan matrix.

Refunds are governed by our Refund Policy and, where applicable, by Turkish consumer-protection law (see Mesafeli Satış Sözleşmesi at /legal/mesafeli-satis).

7. Acceptable use

You agree not to:

access the Service by any means other than the provided UI or documented APIs;
scrape, mirror, or otherwise programmatically extract DataGreat content beyond your plan's API allowance;
reverse-engineer, decompile, or attempt to derive source code;
resell, redistribute, or sublicense raw underlying datasets (in particular WTTC, World Bank, and IMF data) except as expressly permitted by their respective licences and our agreement;
use the Service to send spam, phishing, malware, or other prohibited content;
abuse Sherpa or other AI tools to circumvent quotas or to generate content that violates our Acceptable Use Policy;
impersonate any person or organisation;
use the Service in violation of any law or regulation in your jurisdiction or ours.

We may suspend or terminate access for violations.

8. Intellectual property

8.1 DataGreat-owned IP

The Service — including code, branding, UI, structure, and documentation — is owned by DataGreat or its licensors and protected by intellectual property law.

8.2 Licensed third-party data

Underlying datasets are licensed from third parties (notably WTTC). Your use of those datasets through the Service is sublicensed under the terms of those underlying licences. You are responsible for respecting attribution requirements where the third-party licence mandates them.

8.3 Your content

You retain ownership of content you create within the Service (personas, briefs, simulations, Lab notes, etc., collectively "User Content"). You grant DataGreat a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit, and display your User Content as necessary to operate the Service. You also authorise us to use de-identified, aggregated metadata for product improvement.

8.4 AI outputs

Outputs generated by AI tools at your request are licensed to you on a worldwide, perpetual, royalty-free basis for your business use, subject to: (i) the AI disclaimer in §5; (ii) the underlying third-party data licences; and (iii) these Terms. We do not warrant that AI outputs are free of similarities to outputs generated for other users; you may not assert exclusive rights against DataGreat or any other user on the basis of an AI-generated artefact.

8.5 Feedback

If you provide feedback or suggestions, we may use them without restriction or compensation.

9. Privacy & personal data

Personal data we process about you is governed by our Privacy Policy (English) and KVKK Aydınlatma Metni (Türkçe), available at /legal/privacy and /legal/kvkk. By using the Service you acknowledge that we may process personal data in line with those documents.

Where you upload personal data of third parties (e.g., colleague email addresses), you confirm that you have a lawful basis to do so.

10. Confidentiality

Both parties may receive confidential information from the other. Each party agrees to use the other's confidential information solely to perform under these Terms and to protect it with at least the same care it uses for its own confidential information of similar sensitivity. This obligation does not extend to information that is public, independently developed, or required to be disclosed by law.

11. Term & termination

These Terms remain in effect while you use the Service. Either party may terminate at any time:

by you, by cancelling your subscription and ceasing use of the Service;
by us, immediately upon material breach (including non-payment), upon written notice for convenience (with refund of pre-paid unused fees), or where required by law.

On termination, your right to use the Service ends, but the following sections survive: 5 (AI disclaimer), 7 (Acceptable use), 8 (IP), 10 (Confidentiality), 12 (Limitation), 13 (Indemnification), 16 (Governing law).

You may export your User Content for 30 days after termination, after which we may delete it. Personal data is deleted in accordance with our Privacy Policy retention schedule.

12. Disclaimers & limitation of liability

To the maximum extent permitted by applicable law:

(a) The Service is provided AS IS, without warranties of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of data.

(b) Neither party is liable to the other for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, even if advised of the possibility.

(c) Our aggregate liability for all claims arising under or in connection with these Terms shall not exceed the amount you paid us under your subscription in the twelve (12) months preceding the event giving rise to the claim, or one hundred (100) US dollars, whichever is greater.

These limits do not apply where prohibited by Turkish Code of Obligations Article 115 (gross negligence or wilful misconduct), nor to claims that cannot be limited or excluded under applicable consumer-protection law.

13. Indemnification

You agree to indemnify, defend, and hold harmless DataGreat, its affiliates, and their officers, directors, employees, and agents from and against any third-party claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (i) your User Content; (ii) your breach of these Terms; (iii) your violation of any law or third-party right; or (iv) your use of AI outputs in violation of §5.

14. Force majeure

Neither party is liable for failure or delay in performance caused by events beyond its reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, governmental action, labour disputes, internet outages, or third-party vendor failures (including but not limited to Stripe, Anthropic, Supabase, Vercel, and Resend).

15. Modifications

We may modify these Terms from time to time. Material changes will be notified by email and via the Service at least fourteen (14) days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the modified Terms. If you do not agree, you must stop using the Service before the effective date.

16. Governing law & dispute resolution

These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-laws rules. The courts and enforcement offices of Edirne, Türkiye shall have exclusive jurisdiction over any disputes, except that consumers retain the right to bring claims in their place of residence and through the applicable Tüketici Hakem Heyeti / Tüketici Mahkemesi as required by the Consumer Protection Law (Law No. 6502).

For B2B disputes between merchants, parties may instead agree to binding arbitration under the rules of the Istanbul Arbitration Centre (ISTAC), seated in Istanbul, in English, by one arbitrator.

17. Miscellaneous

Entire agreement. These Terms (together with the Privacy Policy, KVKK Aydınlatma Metni, the Mesafeli Satış Sözleşmesi where applicable, and any plan-specific addenda such as DPA or SLA) constitute the entire agreement between you and DataGreat.
Severability. If any provision is held invalid, the remaining provisions remain in effect.
No waiver. Failure to enforce any provision is not a waiver of future enforcement.
Assignment. You may not assign these Terms without our consent. We may assign without restriction.
Notices. Legal notices to us must be sent to info@datagreat.com and copied to the postal address listed in §1.
Language. These Terms are issued in English. A Turkish translation may be made available for convenience; in case of conflict, the English version controls, except in disputes with Turkish consumers where Turkish-language documents (including the Mesafeli Satış Sözleşmesi) shall govern.
