Pre-Contract Information Form

Required by Articles 5 and 7 of the Turkish Distance Contracts Regulation (Mesafeli Sözleşmeler Yönetmeliği) under Consumer Protection Law No. 6502 (Tüketicinin Korunması Hakkında Kanun — "TKHK"). This form must be displayed and acknowledged by the consumer before any payment is taken. The Distance Sales Agreement at /legal/mesafeli-satis follows it.

1. Seller

2. Buyer (Consumer)

The name, email address, billing details, and payment instrument provided during account registration and at the moment of payment authorisation.

3. Subject Matter and Essential Characteristics of the Service

The DataGreat platform provides digital subscription content. Active tier and term are selected at the moment of purchase. The current tier matrix is published at datagreat.com/pricing and forms an integral part of this agreement.

Prices are in US Dollars and may also be charged in Turkish Lira at the prevailing exchange rate at the time of payment.

4. Payment

Payment processor: Stripe Payments Europe Ltd. (PCI-DSS compliant)
Accepted methods: credit and debit cards via 3D Secure
Billing cycle: monthly or annual, automatically renewing on the anniversary of the subscription start date
Taxes: VAT and other applicable taxes are not included in the listed prices and are charged separately at the prevailing rate
Overage: when the monthly report quota is exceeded, additional reports are charged on certain tiers (Researcher: $5 each; Analyst: $3; Agency: $2; Institute: included)

5. Performance and Delivery

The Service is digital content delivered electronically and performed instantly. On confirmation of payment, access is activated immediately. There is no physical shipment.

6. Right of Withdrawal and the Statutory Exception

Under Article 9 of the Distance Contracts Regulation, consumers generally have a fourteen (14) day right of withdrawal without giving any reason.

However, Article 15(1)(ğ) of that Regulation excludes "services performed instantly in electronic environment or intangible goods delivered to the consumer instantly" from the right of withdrawal.

The DataGreat service falls within this exception. By approving this form and the Distance Sales Agreement at the moment of purchase, the consumer acknowledges and consents to:

"I request that performance of the contract begin immediately upon confirmation of my payment, and I expressly waive my right of withdrawal."

This acknowledgement is collected by a separate checkbox at checkout.

In favour of the consumer, the parties further agree:

Monthly subscriptions may be cancelled at any time; cancellation takes effect from the next billing period; no pro-rata refund is made for the in-progress period.
Annual subscriptions are not pro-rated upon cancellation; access continues until the end of the period.
Where the Service cannot be performed due to mis-charging or technical fault, the Seller will issue a pro-rata refund or credit.

7. Complaints and Dispute Resolution

For disputes arising from this agreement, the consumer may apply to:

The Consumer Arbitration Committee (Tüketici Hakem Heyeti) closest to the consumer's residence (within the monetary thresholds set annually by the Ministry of Trade);
The Consumer Court (Tüketici Mahkemesi) of the consumer's residence; or
The Edirne Consumer Arbitration Committee or Consumer Court (the Seller's registered location).

8. Personal Data

Personal data is processed in line with the Personal Data Processing Notice (KVKK) at /legal/kvkk and the Privacy Policy at /legal/privacy.

9. Effect

After acknowledging this form, the consumer is taken to the Distance Sales Agreement page. Approving that agreement completes the order and activates the subscription. This form, together with the agreement, constitutes the binding contract between the parties.
